The crypto space is littered with scams (all industries have scams) and a touch of regulation could bring in some major movements to bitcoin and altcoins.

This is why:

* Reporting data is horrific. Exchanges have the ability to pump up trading volume and make certain cryptocurrencies have a fake volume. Often this is used to lure investors into believing the crypto is being traded. I witnessed this first hand with a crypto called RPM, I bought $100 worth (I knew it was risky) and a month later it was up 5X. When I went to sell it on the exchange there wasn’t a single buy order in place, but when I checked the 24 hour volume, the coin it was in the millions, yet on the only exchange that traded RPM did not have a single buy order and no sell order had been triggered in over 2 weeks.

* Certain markets can be manipulated and if we ever want to see a Bitcoin ETF it’s important to weed out the manipulation so investors can put their money into something that is based off of a fair market value. Not many crypto investors may care about a bitcoin ETF, but they should reconsider as an ETF will help bring in trillions of dollars into the marketplace.

* Custodial services have been a big issue in crypto and every single month we see an exchange either get hacked, lose investor funds, or spend investor funds. Sadly, this happens with big money - Bitfinex lost 850 million - Quadriga lost150 million - Binance lost 7000 bitcoin in a hack.

What we don’t need with regulation:

* An all out ban on cryptos which would be a pathetic attempt at best. Governments have failed for centuries trying to outright ban things and a ban on a digital asset would be impossible and would only place a burden on taxpayers as it would turn into an enormous waste and increase excess government spending. Also, anytime something becomes illegal the price of it increases exponentially and a ban on crypto wouldn’t rid the would or them, instead investors would have a big incentive to hold on as the price skyrockets.

* Banning cryptos would hurt any economy as it is one of the fastest growing technologies and every country in the world is in a constant arms race to have home grown companies develop the next game changing technology. Currently, the US and China are in a trade war and its foolish to think that one side would let the other get a leg up due to a backwards view on cryptocurrencies.

* Over-burdening regulation, such as only allowing money transfer services the right to send cryptos back and forth. There is major human rights issue on a global scale with governments telling people what they can and cannot make transactions with. It has nothing to do with legality and has everything to do with control. By controlling what people use to make monetary transactions, governments have enslaved their citizens and forced themselves into their privacy and violating rights as human beings. Creating regulation that only allows money transfer services the right to send and receive crypto would be a violation of human rights.

* What the government should do:

* Make cryptocurrencies a separate asset class and create a new framework for raising capital with cryptocurrencies. The Howey test is extremely dated and cannot be used to establish a security with this new type of technology.

* Spend a majority of regulation on data reporting in crypto and custodial safety. We want to prevent data manipulation and prevent exchanges from losing funds.

* Work with the top people in the space to develop laws that allow honest-fair market trading and do not violate our rights as humans to use cryptocurrrencies. This space has some of the smartest people from all sorts of industries - Law, Finance, Technology and working with these people to create new laws will help promote the safe usage and adoption of crypto.

This is a public episode.
